1. COMPANY INFORMATION
The website www.silknpaper.com is owned and operated by PAPETTE DISTRIBUTION SRL, registered office: Bdul Basarabia no. 256, Sector 3, 030352, Bucharest, Romania, listed with the Trade Registry under J40/14693/2018, VAT no. RO39991898.
Access to and use of the website implies full and unconditional acceptance of these Terms & Conditions. Silk N Paper reserves the right to amend these terms at any time without prior notice.
2. SCOPE
These Terms & Conditions govern the sale and use of products offered through www.silknpaper.com.
The shop serves both business customers (B2B) and consumers (B2C) across all EU Member States.
3. PRODUCTS AND ORDERS
Products include, without limitation: custom and plain tissue paper, seasonal patterned paper, paper filler and personalised self-adhesive labels.
Orders are placed online by following the full checkout flow (selection, basket, confirmation and payment).
Submitting an order constitutes acceptance of these Terms & Conditions in full.
4. PROCES AN PAYMENT
All prices shown on www.silknpaper.com are in euro (EUR) and are exclusive of VAT (net prices).
VAT is added automatically at checkout, depending on the customer’s tax status and the destination country, as follows:
4.1. EU business customers (B2B)\
For deliveries outside Romania but within the EU, no VAT is charged if a valid EU VAT number is provided at checkout.
VAT numbers can be verified via the European Commission VIES system: https://ec.europa.eu/taxation_customs/vies/#/vat-validation.
If no valid VAT number is provided, the system will automatically add 21% VAT to the order total.
4.2. Consumers (B2C) and businesses without a VAT number
For orders placed by consumers or legal entities not registered for VAT, prices are displayed net and the system will automatically add 21% VAT at checkout.
4.3. Romanian customers (B2B/B2C)
For orders delivered in Romania, the 21% VAT rate applies under Romanian tax law.
4.4. Payment methods
Payment may be made using the methods available at checkout (secure card payment, bank transfer, or other electronic methods indicated on the site).Full payment is required before dispatch.
The tax invoice will be issued electronically to the email address provided at the time of ordering.
4.5. Intra-EU B2C distance sales (OSS)
For intra-EU B2C distance sales, where applicable we apply destination-country VAT via the One-Stop Shop (OSS) scheme; below the EU cumulative threshold (currently EUR 10,000/year) we may apply Romanian VAT (21%), in line with EU rules. The VAT shown at checkout reflects the applicable regime.
5. DELIVERY
We deliver via courier services to all EU Member States.
Indicative delivery time: 3–7 working days, depending on destination.
The customer must check the parcel upon receipt and report any non-conformity within 24 hours.
6. RETURNS POLICY

6.1. Right of withdrawal – non-custom products
In accordance with Directive 2011/83/EU and Emergency Government Ordinance (O.U.G.) no. 34/2014, Art. 9(1):
"The consumer has the right to withdraw from a distance contract, without giving any reason, within 14 calendar days from the day on which they acquire physical possession of the goods."
Consumers (B2C) may return non-custom products within 14 calendar days of receipt.
6.2. Return process
To initiate a return, the customer must notify the supplier in writing by email at: returns@silknpaper.com
The message must include:\
order number;
items to be returned;
(optional) reason for return;
full contact details.
Items must be returned in their original packaging, unused and undamaged, together with a copy of the invoice.
6.3. Return costs and transport risk
Return shipping costs are borne entirely by the customer.
If the product is damaged during return transport, Silk N Paper reserves the right to refuse a full refund or to grant a partial refund based on the condition of the returned item.

6.4. Refunds
Refunds will be processed within 7 working days from receipt and inspection at our warehouse.
The customer will receive an email confirming the return and the condition of the items received.
Refunds are made, by default, to the same account and using the same payment method as the original transaction.
At the customer’s express written request, refunds may be made to a different bank account indicated in the return request.
Refunds are issued in full (100%), without deductions or fees, subject to Article 6.3.
6.5. Custom products
Under O.U.G. 34/2014, Art. 16(c), the right of withdrawal does not apply to "goods made to the consumer’s specifications or clearly personalised."
Accordingly, custom products (e.g., tissue paper printed to order, personalised stickers) cannot be returned, except where a clear manufacturing defect is confirmed by Silk N Paper’s quality control.
7. CLAIMS AND NON-CONFORMITIES
Any visual/technical non-conformity (e.g., shade variation, bent corner, printing defect) must be reported by email within 48 hours of receipt, including clear photos and details of the issue.
If the claim is justified, Silk N Paper will replace the product or refund the full amount.
8. INTELLECTUAL PROPERTY
This section governs intellectual property rights over all materials created, used or made available via www.silknpaper.com, as well as the parties’ responsibilities regarding content supplied for product personalisation.
Silk N Paper / Papette Distribution SRL complies with Romanian and EU copyright laws, and customers must observe the same standards in their contractual relationship with us.
8.1. Intellectual property – Silk N Paper / Papette Distribution
All graphics, photographs, texts, logos, designs, page structure, digital content and any other materials published on www.silknpaper.com are the exclusive property of Silk N Paper / Papette Distribution SRL and are protected under Romanian and EU intellectual property laws.
Any reproduction, distribution, modification, transmission, publication, display, sale or other use, in whole or in part, without prior written consent is strictly prohibited and punishable under applicable law.
Any content used with Silk N Paper’s express consent may be used only under a written agreement between the parties.
8.2. Intellectual property – client-supplied materials
The client warrants that they hold all lawful rights over any graphics, images, logos, texts, drawings, trademarks or other materials supplied to Silk N Paper / Papette Distribution SRL for product personalisation. By submitting such materials, the client declares that:\
they are the rightsholder or hold valid usage rights;
our use of the materials for production does not infringe any third-party rights;
they assume full legal responsibility for the content, originality and lawfulness of the materials.
Silk N Paper / Papette Distribution SRL cannot be held liable for any infringement (copyright, trademarks or similar) caused by client-supplied materials. In the event of such infringement, all responsibility, including any damages, lies exclusively with the client.
9. LIMITATION OF LIABILITY
Silk N Paper is not liable for delays or non-performance caused by external factors (carriers, major events, force majeure).
Minor shade differences between on-screen images and the actual products are not considered defects.
10. DATA PROTECTION (GDPR)
In accordance with Regulation (EU) 2016/679 (GDPR), Silk N Paper is committed to protecting the confidentiality and security of personal data.
The data collected (name, address, phone, email, billing details) are used solely for order processing, delivery and strictly necessary transactional communications.
Data are not shared with third parties except service providers directly involved in delivery and invoicing.
Customers may at any time request access, rectification, erasure or restriction of processing by emailing office@silknpaper.com.

12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms & Conditions are governed by the laws of Romania and EU law, in particular Directive 2011/83/EU and O.U.G. no. 34/2014, together with other applicable legislation.
Any dispute will be settled amicably where possible. Failing that, the competent courts are those of Romania, at the registered office of PAPETTE DISTRIBUTION SRL.
